Džomić:Kad bolje vidi i predlagač će da se stidi!
Teško je pronaći razlog zbog čega se predlagač nije potpisao. Osim ako se ne stide predloga i svog višegodišnjeg (ne)rada, piše protojerej-stavrofor doc. dr Velibor Džomić za dnevni list Dan povodom predloga da se usvajanje Zakona o slobodi vjeroispovijesti odloži za drugi kvartal 2015. godine.
„Iako na dokumentu, koji je objavljen na zvaničnom sajtu Vlade, nije naveden naziv predlagača može se zaključiti da je predlog uputilo Ministarstvo za ljudska i manjinska prava. Taško je pronaći razlog zbog čega se predlagač nije potpisao. Osim ako se ne stide predloga i svog višegodišnjeg (ne)rada. No, to nije ni najveća, a ni jedina mana ovog dokumenta.“, smatra Džomić.
On dodaje da pomenuto ministarstvo nema zvaničnu strategiju u pogledu normativnog uređenja prava na slobodu vjeroispovijesti i položaja crkava i vjerskih zajednica, kao ni adekvatne ljudske resurse koji bi ovaj posao sproveli. Takođe navodi da Ministarstvo nema ni direktora Direktorata za odnose sa vjerskim zajednicama jer je Ivan Jovović podnio ostavku na ovo mjesto.
„Ministarstvo iz godine u godinu pompezno najavljuje donošenje novog zakona i uključuje ga u Program rada Vlade Crne Gore, ali, po pravilu, pri kraju svake godine Vladi upućuje i predlog da se izvrši izmjena Programa rada i to tako što se preuzeta obaveza prenosi u narednu godinu. Uočljivo je da jedino mijenjaju kvartale!“, piše protojerej-stavrofor Mitropolije crnogorsko-primorske.
Džomić dodaje da ove činjenice dovoljno govore „o neozbiljnom pristupu i neodgovornosti funkcionera u Ministarstvu za ljudska i manjinska prava“.
„Ne treba posebno isticati da se na takav način ponižavaju vjernici, Crkva i vjerske zajednice, zatim, derogira postupak donošenja zakona i urušava kredibilitet tog resora. Ocjena je još nepovoljnija kada se pročita katastrofalno obrazloženje Ministarstva“, piše Džomić za Dan.
On dalje navodi da Ministarstvo kao razloge navodi da je postojeći Zakon donijet u bivšem društveno-političkom sistemu, te da je prepoznata potreba za izradom novog normativnog akta.
Džomić navodi da Ministarstvo o trošku poreskih obveznika dugo ponavlja istu priču o potrebi izrade normativnog akta.
On objašnjava da Crna Gora nije 2006. stekla državnost, već je obnovila nezavisnost i međunarodno-pravni subjektivitet.
„Navodno nedavna „stečena državnost“ Crne Gore je, prema tumačenju Ministarstva, uslovila i nekakav ‘drugačiji pristup u sferi uređenja pravnog položaja’, odnosno prava i obaveza vjerskih zajednica u ustavno-pravnom okviru Crne Gore“, piše Džomić.
Dodaje da u novom zakonu ne može biti normiran „drugačiji pristup“ od pristupa koji je normiran u ustavnim odredbama, te da postoji bojazan da bi neko iz Ministarstva za ljudska i manjinska prava mogao da sačini zakon koji bi bio u suprotnosti sa važećim Ustavom.
Navodi da je Ministarstvo obavijestilo da je ministar dr Suad Numanović donio rješenje o formiranju radne grupe za izradu Predloga zakona o slobodi vjeroispovijesti.
„Frapantno je da ministar i njegovi saradnici ne znaju da ministarstvo ne utvrđuje predlog nego nacrt zakona. A tek ih treba prepustiti sudu pravničke struke i šire javnosti zbog nepoznavanja postupka o formiranju radne grupe koja se formira odlukom, a ne rješenjem!?“, piše Džomić.
Zaključuje da ostaje da se čeka na „nove demonstracije neznanja u daljem postupku izrade Nacrta zakona o slobodi vjeroispovijesti“.
