Radunović Signed an Unlawful Construction Permit for Alcazar Energy’s Bijela Wind Farm – Lawsuits and Criminal Complaints to Follow
The Ministry of Spatial Planning, Urbanism and State Property issued, and Minister Slaven Radunović signed, a construction permit for the Bijela Wind Farm and its connecting transmission lines, despite the fact that at the time the permit was issued, there was no lawful and legally final approval from the Environmental Protection Agency for the Environmental Impact Assessment Report, affected residents of the village of Duži and the “Save Brezna” Citizens’ Initiative, which represents the affected local community in Brezna, said in a statement.
Affected residents claim that the planned transmission lines threaten nature, habitats, private property, health and tourism facilities.
They stress that the “green” permit previously issued by the Environmental Protection Agency was annulled following appeals by residents of Duži, and that the Agency committed a series of procedural and legal violations in the reopened proceedings, prompting the affected residents to lodge fresh appeals.
“Neverheless, Minister Radunović signed a construction permit for Dubai-based Alcazar Energy Partners that fails to meet basic legal requirements, one of which is the existence of lawful and legally final approval from the Environmental Protection Agency. Specifically, the construction permit was issued on 24 September 2026, one day before the deadline for lodging appeals against the new approval decision. The affected residents and the ‘Save Brezna’ Citizens’ Initiative submitted several appeals against this decision within the prescribed deadline. Yet the developer and Minister Radunović were apparently in such a hurry that they flagrantly violated even the affected residents’ procedural rights,” the statement reads.
The affected residents demand that Radunović immediately annul the unlawfully issued construction permit and announce lawsuits and criminal complaints.

Alcazar Energy Partners Is Blackmailing Us and Threatening Expropriation
“The entire permitting process for the Bijela Wind Farm is riddled with unlawful acts, which were also confirmed by the initial annulment of the ‘green permit’. The new ‘green permit’ was issued on identical grounds and neither resolved nor remedied the unlawful acts identified in the Ministry of Ecology’s original annulment decision. In view of these facts, which are clearly set out in the appeals against the new ‘green permit’, we ask: How was the original approval unlawful, while the new approval is supposedly lawful, when both EPA approvals rest on the same unlawful grounds that had already been identified and challenged, and which Alcazar Energy Partners, or its Montenegrin subsidiary Vjetro park Bijela, has failed to remedy? How did the Ministry of Ecology recognise those unlawful acts in the challenged approval, yet fail to see them in the new one?” the affected residents ask.
They add that they will continue to take all legitimate legal and other action to protect their property, tourism facilities, health and future on their ancestral land.
They say their legal team will bring proceedings before the Administrative Court and file criminal complaints with the Special State Prosecutor’s Office against those responsible throughout the chain.
“Over the past 18 months, since we learned by chance of the plan to build a wind farm and transmission lines across our properties, we have gathered more than enough evidence—not just for our courts, but for Strasbourg. All the evidence is already with our lawyers, and legal action will be initiated very shortly. We have reasonable grounds to suspect that an organised group was formed with the task of securing a construction permit for the Bijela Wind Farm. There is also a clear motive, which will be brought to the attention of the judicial authorities and the wider public,” the statement reads.
They add that over the past year and a half they have endured threats, intimidation and blackmail, which have also been documented, with a substantial part of that material forwarded to the competent institutions.
They also recall that they have already brought several cases before the Administrative Court, requesting urgent consideration, and expect the Court to rule lawfully and independently on these cases as a matter of the utmost urgency.
The Developer’s Applications Advanced While Residents Were Denied Even Their Procedural Rights
The Ministry annulled the EPA’s first approval, No. 03-UPI-2482/33 of 26 December 2025, on 20 April 2026. The deficiencies identified included unexplained information concerning land parcels and insufficient consideration of the transmission line route’s impacts on protected areas. The EPA issued a new approval, No. 03-UPI-2482/122, on 8 September 2026, before the appeal proceedings concerning recognition of party status had concluded. Construction permit No. UPI 06-333/25-6802/49 was issued on 24 September, relying on the new EPA approval. One of the affected residents lodged an appeal against that approval on 23 September—the day before the Minister signed the permit.

This case illustrates how a landowner is shut out of the proceedings. In the decision rejecting his appeal, which he received yesterday, the Ministry acknowledges that parcels 1444 and 1442 in the Gornja Brezna cadastral municipality appear in the documentation accompanying the revised Environmental Impact Assessment Report. Nevertheless, it dismisses their significance on the grounds that they were not listed in the developer’s application.
They also point out that the competent Ministry took several months to decide on appeals against the previous EPA approval, whereas the current proceedings were concluded at remarkable speed, with the decisions received so far rejecting the appeals, despite the documented fact that the requirements set out in the decision annulling the previous approval had not been met. During the reopened proceedings, the Environmental Protection Agency refused requests for access to documentation crucial to the decision.
The documentation requested by the affected residents through the MANS application on 4 February 2026 was not provided by the EPA until October, after the appeal proceedings and after both permits had been issued. More than eight months of waiting demands an answer: why was the documentation not provided while it could still have served to protect citizens’ rights in time?
“Finally, we warn all parties involved that we will not allow our private property and our future in this area to be unlawfully taken away and destroyed. If anyone arrogantly proceeds with any construction on the basis of unlawful decisions and permits, we will physically defend ourselves as well. Everyone in the chain who takes part in this will have to be held accountable,” they conclude.
