Kompanija Sveti Stefan hoteli pokrenula arbitražni postupak pred sudom u Londonu protiv zakupca Aman i Adriatic Aroperties

Kompanija Sveti Stefan hoteli pokrenula je arbitražni postupak pred sudom u Londonu protiv zakupaca hotela Sveti Stefan i Miločer, preduzeća Adriatic Properties i Aman, kako bi zaštitila svoja prava iz ugovora, ali i kapital akcionara i imovinu društva.
Ta kompanija je na sjednici Odbora direktora u petak donijela odluku o pokretanju postupka zaštite prava pred arbitražnim sudom u Londonu u skladu sa ugovorom o dugoročnom zakupu hotela Sveti Stefan i Miločer od 31. januara 2007. godine i aneksom i ugovora od 5. januara 2013, zaključenim sa preduzećem Adriatic Properties.
Iz menadzmenta kompanije Sveti Stefan hoteli su kazali da se nekorišćavanjem imovine, koja u ovom slučaju predstavlja najljepši i najvrijedniji dio Jadranske obale, progresivno umanjuje njena vrijednost.
“Stoga je kompanija Sveti Stefan hoteli obavezna da preduzme radnje kojima bi se preduprijedilo nastupanje štete po društvo i imovinu. U tom pogledu, obratili smo se međunarodnom tribunalu sa sjedištem u Londonu, da na brz i efikasan način riješi sporna pitanja u vezi sa ispunjenjem ugovora i na taj način obezbijedi da Adriatic Properties i Aman poštuju ugovorne i zakonske obaveze koje se tiču upravljanja hotelima na Svetom Stefanu”, navodi se u saopštenju menadzmenta.
Hoteli Sveti Stefan i Miločer ostali su zatvoreni ove godine, kao i da postoje ozbiljne indicije da će se to desiti i naredne.
Kako su dodali, zakupac i Aman otvaranje hotela ucjenjuju dobijanjem garancija koje su pravno neodržive u smislu ugovora o zakupu i crnogorskih zakona.
Iz kompanje Sveti Stefan hoteli su objasnili da su prije usvajanja takve odluke preduzeli sve aktivnosti kako bi omogućili zakupcu da izvršava ugovorne obaveze shodno dogovorenim standardima poslovanja.
“U ranijem periodu, kompanija Sveti Stefan hoteli je sporazumnim putem pokušala da riješi sva otvorena pitanja u odnosu sa zakupcem i preuzimala je pravne radnje pred nadležnim organima u cilju zaštite prava zakupca iz ugovora”, navodi se u saopštenju.
Oni su naveli da je zakupac najavio pokretanje arbitražnog postupka protiv zakupodavca insistirajući da je zakupac dužan da obezbijedi pomenute garancije, zbog čega su ugovorne strane ušle u pregovore oko rješavanja spora.
“Cijeneći držanje zakupca tokom pregovora i neiskazivanje iskrene namjere za mirno rješavanje spora, kompanija Sveti Stefan hoteli je bila primorana da pokrene arbitražni postupak protiv zakupca i Amana, kako bi zaštitila svoja prava iz zgovora, ali i kapital akcionara i imovinu društva, imajući u vidu činjenicu da imovina društva održava visoku vrijednost samo ukoliko se koristi i održava u skladu sa ugovorom”,zaključuje se u saopštenju.
