Od početka godine pet osoba osuđeno na zatvor zbog neplaćanja alimentacije
U budžetu za ovu godinu potrebno je planirati sredstva za osnivanje alimentacionog fonda, zbog čega će Socijaldemokrate podnijeti amandman na Predlog zakona o budžetu za 2021, najavio je poslanik te partije Boris Mugoša. Tačan broj roditelja koji ne učestvuju u izdržavanju svoje djece, odnosno ne uplaćuju alimentaciju, nepoznat je, ali po raspoloživim podacima, kako navode Socijaldemokrate, samo jedna trećina roditelja uredno plaća alimentaciju za svoju djecu, pišu Dnevne novine.
Godinama unazad veliki problem je bio i što roditelj koji ne izvršava tu svoju obavezu ne bude tužen, iako čini krivično djelo. Ipak, dio njih završi na sudu, a prema podacima Osnovnog suda u Podgorici za prva četiri mjeseca tekuće godine donijete su 32 presude zbog krivičnog djela nedavanje izdržavanja, a pet roditelja osuđeno je na kaznu zatvora.
“Obavještavamo vas da su u Osnovnom sudu u Podgorici, u periodu od 1.1.2020. godine do 1.5.2021. godine, donijete 32 presude zbog krivičnog djela nedavanje izdržavanja iz čl. 221KZ CG, te da je u istom periodu izrečeno pet kazna zatvora iz čl. 36a KZ CG”, saopšteno je Dnevnim novinama iz podgoričkog Osnovnog suda.
Upravo zbog nesavjesnosti jednog roditelja osnivanje alimentacionog fonda predstavlja važan mehanizam podrške drugom, samohranom roditelju djeteta.
Poslanik Mugoša je na skupštinskom Odboru za zdravstvo, rad i socijalno staranje prilikom razmatranja predloga Budžeta kazao da će predložiti da se u okviru predviđenih sredstava budžetske rezerve izdvoji iznos za osnivanje alimentacionog fonda, odnosno da je umjesto budžetiranja novih potrebna preraspodjela namjene postojećih planiranih sredstava budžeta.
“Zbog svega toga, očekujem da u narednih nekoliko mjeseci donesemo zakonski okvir za osnivanje alimentacionog fonda, gdje bi taj fond na sebe preuzimao isplaćivanje alimentacije samohranom roditelju u slučaju nesavjesnih roditelja koji izbjegavaju da plaćaju alimentaciju, a fond (država) bi koristeći zakonske mehanizme vršio naplatu od obveznika alimentaciju”, saopštio je Mugoša.
Kako je dodao, negativne posljedice pandemije korona virusa dodatno su aktuelizovale ovu problematiku, jer znatan broj roditelja je izgubio posao, a mnogima su poprilično smanjeni prihodi.
Iz Socijaldemokrata podsjećaju na podatke Monstata koji pokazuju da skoro 60 odsto razvedenih brakova čine brakovi sa djecom, od čega je starateljstvo nad izdržavanom djecom u 79,4 odsto slučajeva povjereno majci, u 9,8 odsto ocu, u 10,2 odsto roditelj ima i u 0,6 odsto drugim osobama i ustanovi.
“Alimentacioni fond je pravni institut koji postoji u zemljama Evropske unije i kvalitetna uporedna praksa može poslužiti za koncipiranje adekvatnog modela podrške države samohranim roditeljima (npr. u Hrvatskoj je donijet Zakon o privremenom izdržavanju, u Sloveniji je osnovan Javni garantni fond za izdržavanje i invalidsko osiguranje i dr.)”, podsjetio je Mugoša.
