SDT: Podigli smo optužnice protiv 111 pripadnika DPS-a i njihovih koalicionih partnera
Imajući u vidu da su u prethodnom periodu više puta u javnosti isticani netačni navodi da Specijalno državno tužilaštvo nije ostvarilo značajnije rezultate u borbi protiv organizovanog kriminala i korupcije, čime se doprinijelo negativnoj percepciji o radu Specijalnog državnog tužilaštva i rezultatima koji su ostvareni u proteklom periodu, u cilju pravilne informisanosti, želimo da ponovo upoznamo javnost sa podacima koji su i do sada bili javno dostupni, saopštili su iz SDT-a.
Njihovo saopštenje prenosimo integralno:
“U periodu od osnivanja od 03.07.2015. do 01.01.2021.godine, Specijalno državno tužilaštvo je donijelo ukupno 143 naredbe o sprovođenju istrage, protiv ukupno 1161 fizičkog i 279 pravnih lica, od toga je za krivična djela organizovanog kriminala donijeto 78 naredbi o sprovođenju istrage, protiv 687 fizičkih i 88 pravnih lica; za krivična djela visoke korupcije 48 naredbi o sprovođenju istrage protiv 221 fizičkog i 20 pravnih lica; za krivično djelo pranje novca 12 naredbi o sprovođenju istrage protiv 191 fizičkog i 164 pravna lica; za krivično djelo terorizam 2 naredbe o sprovođenju istrage protiv 15 lica; za krivično djelo ratni zločin jedna naredba o sprovođenju istrage protiv 1 lica; i za ostala krivična djela (utaja poreza i doprinosa, neovlašćena proizvodnja, držanje i stavljanje u promet opojnih droga i dr.) 2 naredbe o sprovođenju istrage protiv 46 fizičkih i 7 pravnih lica.
Za isti vremenski period Specijalno državno tužilaštvo je podiglo 127 optužnih akata,od čega je 110 optužnica i 17 optužnih predloga, protiv ukupno 713 fizičkih i 63 pravna lica, od toga je za krivična djela organizovanog kriminala podignuta 61 optužnica, protiv 458 fizičkih i 35 pravnih lica; za krivična djela visoke korupcije 45 optužnica protiv 139 fizičkih i 13 pravnih lica; za krivičino djelo pranje novca 11 optužnica, protiv 49 fizičkih i 15 pravnih lica; za krivično djelo terorizam 2 optužnice protiv 6 lica; za krivično djelo ratni zločin 1 optužnica protiv 1 lica; i za krivična djela protiv izbornih prava 7 optužnih predloga, protiv 13 lica, dok su za ostala krivična djela optužena 47 lica.
Nadalje, samo u ovoj godini Specijalno državno tužilaštvo donijelo je 12 naredbi o sprovođenju istrage i jednu naredbu o proširenju istrage protiv ukupno 88 fizičkih i 7 pravnih lica, od čega je za krivična djela organizovanog kriminala donijeto 5 naredbi o sprovođenju istrage protiv 49 lica, za krivična djela visoke korupcije 6 naredbi o sprovođenju istrage protiv 34 fizička i 7 pravnih lica; za krivično djelo pranje novca donijeta je 1 naredba o sprovođenju istrage protiv 4 lica; i za ostala krivična djela 1 naredba o sprovođenju istrage protiv 1 lica.
Takođe, samo u ovoj godini Specijalno državno tužilaštvo je podiglo 8 optužnica protiv ukupno 23 fizička i 1 pravnog lica, od čega za krivično djelo organizovanog kriminala su podignute 6 optužnica protiv 13 fizičkih lica; za krivična djela visoke korupcije podignute su 2 optužnice protiv 6 fizičkih lica; dok su za ostala krivična djela podignuta 1 optužnica protiv 4 fizička i 1 pravnog lica.
Smatramo značajnim da naglasimo da je Specijalno državno tužilaštvo za nepunu godinu dana u borbi protiv krijumčarenja duvana i proizvoda od duvana, ukupno zaplijenilo 17.401 paket ili 17.401.000 komada cigareta, pokrenuto je više krivičnih postupaka za krijumčarenje protiv ukupno 38 fizičkih i 3 pravna lica, a visina utajenog poreza akciza i carina u tim predmetima iznosi preko 70.000.000,00€. Nadalje u toku 2020.godine u okviru istih aktivnosti ukupno je zaplijenjeno 1243 paketa cigareta čija vrijednost iznosi oko 1.200.000,00€, pokrenut je krivični postupak protiv ukupno 8 fizičkih lica, a visina utajenog poreza, akciza i carina iznosi preko 18.000.000,00€.
Kao zaključak prethodno iznijetih podataka ističemo da je izvršenjem krivičnih djela organizovanog kriminala i korupcije i drugih navedenih krivičnih djela nastala imovinska šteta u ukupnom iznosu od 246.635.636,00€, u vezi čega je Specijalno državno tužilaštvo u gore navedenim predmetima podiglo optužne akte i u jednom dijelu, o čemu će u nastavku biti riječi, imovinska šteta je vraćena u Budžet države Crne Gore, dok su u ostalom dijelu postupci i dalje u toku pred nadležnim sudom.
Naime, ono što je veoma značajan podatak, a rezultat je rada Specijalnog državnog tužilaštva iz prethodnog perioda, jeste da je samo kroz primjenu instituta Sporazuma o priznanju krivice oduzeta imovinska korist u ukupnom iznosu od 40.215.660,20€, a samo u periodu od 01.01.2020.godine do danas u 4 krivična predmeta i to: „Vardar“, „Klap“, „VIP“ i „Bora“, vraćena je protivpravno stečena imovinska korist i izrečene su novčane kazne u ukupnom iznosu od 7.162.763,12€, koji iznos je uplaćen na račun Budžeta Crne Gore.
Kao što se može vidjeti iz navedenog u periodu od osnivanja do 01.01.2021.godine, Specijalno državno tužilaštvo je podiglo optužnice protiv 61 kriminalne organizacije sa ukupno 458 fizičkih i 35 pravnih lica, što govori o ozbiljnosti i brojnosti ovih kriminalnih organizacija, ali i naporima koje je Specijalno državno tužilaštvo uložilo na otkrivanju i procesuiranju istih.
Kao posebno značajne rezultate izdvajamo podignute optužnice za krivična djela visoke korupcije, koja se odnose isključivo na politički eksponirana lica i to 37 optužnica, protiv 112 fizičkih lica (PEL), od čega su 111 lica pripadnici političke partije DPS i njihovih koalicionih partnera, a samo jedno lice je pripadnik jedne, ranije opozicione političke partije, što posebno naglašavamo jer je u prethodnom periodu više puta netačno isticano da je Specijalno državno tužilaštvo selektivno u postupanju i da krivično gonjenje i krivične postupke usmjerava i vodi samo protiv pripadnika političkih subjekata koji su pripadnici sadašnje vlasti, odnosno nekadašnje opozicije.
Takođe, od osnivanja Specijalno državno tužilaštvo paralelno vodi i finansijske istrage, pa se tako vodi finansijska istraga protiv ukupno 603 fizička i 180 pravnih lica. U toku trajanja finansijskih istraga Specijalno državno tužilaštvo je podnijelo i predloge za određivanje privremenih mjera obezbjeđenja – zabrane raspolaganja i korišćenje pokretnih i nepokretnih stvari, u okviru kojih je privremeno blokirano pokretnih i nepokretnih stvari u ukupnom iznosu od preko 100 miliona eura. Isto tako, kao rezultat vođenja finansijskih istraga, samo za period od 2018-2020.godine, privremeno je blokirano novčanih sredstava na računima kod poslovnih banaka u iznosu preko 68 miliona eura, od čega samo u predmetu „E commerce“ preko 62 miliona eura. U vezi sa navedenim predmetom Poreska uprava je kroz postupke inspekcijskog nadzora pravosnažno utvrdili obavezu poreza na dobit za dio okrivljenih pravnih lica za 2016 i 2017.godinu, u iznosu od preko 31 milion eura, dok je za ostatak okrivljenih pravnih lica postupak u toku. Inspekcijskom nadzoru su prethodile aktivnosti Specijalnog državnog tužilaštva i formiranog istražnog tima u fazi izviđaja i istrage, a u okviru formiranog istražnog tima bio i predstavnik Poreske uprave. Nadalje, u toku 2020 i 2021.godine, kao rezultat vođenja finansijskih istraga privremeno je blokirano novčanih sredstava na računima kod poslovnih banaka u iznosu preko 3.325.000,00€ i 13.800,00USD.
Konačno, kao jedan od značajnih rezultata finansijskih istraga su i zahtjevi za trajno oduzimanje imovine koji su podnijeti Višem sudu u Podgorici u okviru kojih je trajno oduzet stan površine preko 190m2, čija vrijednost iznosi oko 300.000,00€, vila na primorju čija vrijednost iznosi oko 1.500.000,00€, kao i stambeni prostor površine preko 50m2 i zemljište ukupne površine preko 3000m2.
