FISKALIZACIJU PRIHVATILO 200 ADVOKATA: Novi pregovori Advokatske komore i ministra Sekulovića u ponedjeljak?
Novi sastanak predstavnika Vlade i Advokatske komore o spornoj elektronskoj fiskalizaciji advokatskih usluga i obustavi rada advokata mogao bi se održati u ponedjeljak, pišu Vijesti.
Ovaj put domaćin će, prema nezvaničnim informacijama Vijesti, biti ministar unutrašnjih poslova i koordinator Ministarstva pravde Sergej Sekulović.
Dok traju pregovori, u protekla dva mjeseca skoro 200 advokata se prijavilo za elektronsku fiskalizaciju računa koje izdaju klijentima.
Prema informacijama koje Vijesti posjeduju većina advokata koji se bave poslovnim pravom i radničkim pravima je prihvatila fiskalizaciju i završila tehničku proceduru za priključenje na sistem Uprave prihoda i carina, dok većina advokata koji se bave krivičnim pravom je protiv prelaska na ovakav način obračuna i naplate poreza.
Predstavnici Advokatske komore na sastanku u ponedjeljak će informisati sagovornike o rezultatima i posljedicama izjašnjavanja advokata koji su većinom glasova odbacili ponuđeni tekst sporazuma o prekidu štrajka koji im je ponudilo Ministarstvo finansija, ističu Vijesti.
Protiv sporazuma glasalo je 420, a za 311 advokata. U zapisniku s glasanja se navodi da na osnovu prebrojanih glasova predloženi sporazum nije usvojen, pa je ranija odluka o obustavi pružanja pravne pomoći i dalje na snazi. Međutim, ni advokati koji su protiv štrajka ne mogu da rade jer ih kažnjava Advokatska komora, a može im i ukinuti licencu.
Advokatima su bile sporne određene formulacije u tekstu sporazuma, koje su, kako su tvrdili, mogle da prejudiciraju rješenje. Sada odbačeni sporazum predviđao je da se formira radna grupa od predstavnika advokata i Ministarstva koja bi do kraja septembra donijela svoje zaključke o mogućnosti primjene postojećeg zakona o fiskalizaciji na advokatsku djelatnost, navode Vijesti.
Štrajk advokata traje od 24. maja, zbog čega je odloženo na hiljade ročišta u sudovima i otežan rad tužilaštva jer se osumnjičenima za najteža krivična djela ne može odrediti pritvor bez prisustva advokata. Zbog štrajka ispaštaju i advokati koji su u ovom periodu ostali bez najznačajnijih prihoda.
