Popović: Ministar Purišić ne mari za zakon i prava majki
Zdenka Popović, potpredsjednica Demokrata, ponovo se obratila ministru rada i socijalnog staranja Kemalu Purišiću, obzirom da joj nisu dostavljeni podaci koje je u otvorenom pismu tražila prije gotovo mjesec dana. u kojem je istakla tražene podatke nije dostavio, “iako je od dana podnošenja zahtjeva proteklo skoro 30 dana”.
“Dana 19.04.2017. godine, obratila sam Vam se otvorenim pismom zahtijevajući da Demokratsku Crnu Goru, kao parlamentarnu stranku, i ukupnu javnost, obavijestite o sljedećem: Koliko je ukupno podneseno žalbi Ministarstvu protiv rješenja centara za socijalni rad, kojim je izvršeno umanjenje naknade majkama po osnovu rođenja troje ili više djece? Koliki broj rješenja po podnesenim žalbama je Ministarstvo donijelo u roku od 30 dana od dana predaje žalbi od strane majki? Koliki broj rješenja po žalbama majki je Ministarstvo donijelo po isteku roka od 30 dana od dana predaje žalbi? U kolikom broju predmeta Ministarstvo do sada nije donijelo rješenje po podnijetim žalbama majki, a istekao je rok od 30 dana od dana predaje žalbi?”, navela je Popović.
Kako dodaje, posebno je ukazala da majke, kao stranke u postupku, imaju na zakonu zasnovano pravo i pravni interes da njihova žalba bude riješena u zakonom propisanom roku, kako bi u daljem sudskom postupku mogle štititi svoja prava za slučaj da njihova žalba bude odbijena.
“Tražene podatke nijeste dostavili, iako je od dana podnošenja zahtjeva proteklo skoro 30 dana”, kazala je, smatrajući da po naznačenom zahtjevu Purišić nije postupio ni u kom pogledu.
Kako smatra, Zakonom propisana imperativna norma da rješenje po žalbi drugostepeni organ mora donijeti i dostaviti ga stranci što prije, a najkasnije u roku od 30 dana od dana predaje žalbe, Purišiću i ministarstvu na čijem je čelu “očigledno ne znači ništa”.
“Ni po isteku roka od skoro 90 dana, evidentno je da po više hiljada podnesenih žalbi korisnica prava na naknadu po osnovu rođenja troje ili više djece Ministarstvo još uvijek ne odlučuje, ili pak, po Vašem nalogu, donesena rješenja centri za socijalni rad ne dostavljaju majkama. Grubo kršite zakon i na zakonu zasnovana prava majki za odlučivanje po njihovim žalbama u zakonom propisanom roku, a pri tom ćutite kao da se ništa ne dešava. Podsjećam Vas da ste mi, kao poslanici Demokrata u Skupštini Crne Gore, saglasno članu 50 Poslovnika Skupštine Crne Gore naznačene podatke bili dužni dostaviti najkasnije 15 dana od dana podnošenja zahtjeva”, navodi potpredsjednica Demokrata.
Ona je dodala da kršenje zakona od strane Purišića, na štetu prava majki, “u svakoj demokratskoj državi imalo bi za posljedicu preduzimanje odgovarajućih mjera od strane zaštitnika ljudskih prava i sloboda, kao i od strane upravne inspekcije”.
“Crnoj Gori te institucije ćute, zbog čega Vam je, ministre, i omogućeno da postupate na takav način. Očekujem da ćete, konačno, imajući u vidu značaj navedenog pitanja, traženu informaciju i podatke dostaviti Demokratskoj Crnoj Gori i o istom obavijestiti javnost, bez daljeg odlaganja”, zaključila je Popović.
