SAOBRAĆAJNE KAZNE NEĆE STOPIRATI DOBIJANJE DOKUMENATA
Ustavni sud je ukinuo odredbe Zakona o prekršajima na osnovu kojih je do sada Ministarstvo unutrašnjih poslova (MUP) moglo da zadržava izdavanje saobraćajnih dozvola i drugih dokumenata dok građani ne plate saobraćajne kazne.
Sudije Ustavnog suda su na sjednici 29. maja odlučile da je, takozvano “pasivno izvršenje novčanih kazni preko Registra novčanih kazni” neustavno.
Odluka još nije objavljena u Službenom listu i nije počela da važi.
“Osuđenom, odnosno kažnjenom za prekršaj iz oblasti bezbjednosti saobraćaja, dok ne plati sve novčane kazne i troškove postupka koji su evidentirani u Registru novčanih kazni, neće se dozvoliti registracija ili produženje važenja registracije motornog vozila i izdavanje ili produženje važenja vozačke dozvole”, odredba je koja je ukinuta odlukom Ustavnog suda.
Do sada je bila praksa da građani ne mogu produžiti važenje saobraćajne ili vozačke dozvole, kao ni lična dokumenta ukoliko nijesu platili kazne za prekršaje, poput prekoračenja brzine ili nepropisnog parkiranja.
Sud je ukinuo i odredbu kojom se omogućava da se građanima zbog neplaćenih kazni može zabraniti izdavanje I drugih dokumenata. U pitanju je odredba koja glasi:
“.. zakonom se može propisati zabrana izdavanja ili produženja drugih dozvola, registracije ili izdavanja potvrda iz službene evidencije, dok osuđeni, odnosno kažnjeni ne plati sve novčane kazne i troškove postupka koji su evidentirani u Registru novčanih kazni za prekršaj iz oblasti na koju se zabrana odnosi…”
Ustavni sud je ranije po službenoj dužnosti pokrenuo inicijativu za ocjenu ustavnosti ovih odredbi, jer je suprotno Ustavu da se zadržavaju lična dokumenta građana.
