U Spužu ostala tri budvanska funkcionera
Donedavni predsjednik Opštine Budva Lazar Rađenović i bivši savjetnik u Vladi Aleksandar Tičić napustili su juče spuški istražni zatvor u kojem su proveli posljednjih pet mjeseci, jer Tužilaštvo nije tražilo produženje pritvora.
U dosadašnjem toku postupka saslušana je većina svjedoka na koje bi osumnjičeni Budvani mogli da utiču, pa je to jedan od razloga zbog kojeg Tužilaštvo nije tražilo produženje pritvora.
Za razliku od Tičića koji negira navode iz naredbe za sprovođenje istrage, za Rađenovićevu slobodu najzaslužniji je ipak sporazum o priznanju krivice koji je sa Tužilaštvom sklopio samo dan prije nego što je pušten na slobodu. Shodno sporazumu, Rađenović će u zatvoru provesti 24 mjeseca zatvora i platiti 30.000 eura kazne, a Opština Budva odštetu može tražiti u posebnom, parničnom postupku. Zatvorska kazna od 18 mjeseci odnosi se na slučajeve TQ Plaza, plato na plaži Jaz i Prijevor, dok se šestomjesečna kazna odnosi na slučajeve “Kopirajt” i “Vještica”.
Sporazum, ipak, nije punovažan sve dok ga ne usvoji Viši sud i na osnovu njega ne donese presudu, pojasnio je u razgovoru za DN Rađenovićev advokat Željko Đukanović.
“Nema zakonskog roka u kojem sud treba da odluči po sporazumu o priznanju krivice, ali mu ovaj sporazum mora biti dostavljen najkasnije do prvog ročišta za glavni pretres. Pošto primi zahtjev, sud će pozvati stranke i branioca, a cijeniće da li je priznanje dati svjesno, dobrovoljno, potpuno i u skadu sa dokazima, odlučiće da li da usvoji sporazum. U slučaju da se odluči da ga prihvati, predsjednik vijeća će najkasnije u roku od tri dana donijeti presudu kojom se okrivljeni oglašava krivim u skladu sa sporazumom”, pojasnio je Đukanović.
Aleksandar Tičić, koji je ljetos uhapšen zbog sumnje da je kao menadžer Opštine Budva zloupotrijebio službeni položaj u slučaju “TQ Plaza” i “Jaz”, za razliku od Rađenovića, ne priznaje nijedan navod koji mu Tužilaštvo stavlja na teret. To je za DN kazao njegov advokat Dragoljub Đukanović.
“Moj branjenik ne priznaje da je počinio djelo za koje se tereti. Tvrdi da je nevin i stoga nije ni tražio sporazum o priznanju krivce”, kazao je Đukanović, zadovoljan što se njegov klijent juče našao na slobodi.
Rađenovićev advokat Zeljko Đukanović ukazuje da je praksa do sada pokazala da predlog za sporazumno prizanje krivice uglavnom ide od okrivljenog i njegovog branjenika ka Tužilaštvu.
“Na okrivljenom i njegovom braniocu je da ocijene da li im sporazum ide u korist. U slučaju Rađenovića, s obzirom da su mu na teret stavljena pet produženih krivičnih djela, ocijenili smo da bi za njega najpovoljnije bilo zaključenje ovog sporazuma”, navodi on. Prema njegovim riječima, moguće je da je u budvanskim aferama bilo još inicijativa za sklapanje ovog sporazuma, ali da priznanje nije bilo potpuno i nedvosmisleno kako to zakon predviđa. “Pretpostavljam da je bilo i slučajeva kada su okrivljeni odlučili da u redovnom sudskom psotupku dokažu svoju nevinost jer tvrde da nijesu krivi i nemaju šta da priznaju”, dodao je on.
