Vrhovni sud CG naložio da Casino Avala se iseli i plati oko 20 miliona eura vlasnicima Hotela Avala
Decenijska saga između dvije budvanske kompanije «Beppler & Jacobson Montengro” i “Casino Avala” oko iseljenja iz prostorija koje Casino Avala koristi u Bepplerovom Hotelu “Avala resort&villas” je izgleda došla do kraja nakon posljednje dvije odluke Vrhovnog suda Crne Gore. Mediji su već prenosili okolnosti spora ove dvije kompanije poslije raskida Ugovora o zakupu 2011. godine, nakon čega zakupac «Casino Avala» nije pristajao da napusti prostorije koje je koristio uz čudno obrazloženje da je iste prostorije u Hotelu Avala sam izgradio.
Tokom 2019. godine je djelovalo kao da će se spor okončati nakon pravnosnažnosti sudskih presuda kojima su Casinu Avala naloženi iseljenje i plaćanje ukupnog iznosa od oko 20 miliona eura, međutim do toga nije došlo jer su sudije koje su donijele navedene presude iste ukinule nakon što je Casino Avala pokrenuo postupak legalizacije dijela objekta u Hotelu Avala. Međutim, prema odlukama u koje su medijima date na uvid, Vrhovni sud je prihvatio argumente iz revizije Bepplera i vratio pravnu snagu ukinutim presudama koje su na ovaj način ponovo postale izvršne i Casino Avala je dužan postupiti po njima.
Vrhovi sud Crne Gore je naveo da sama činjenica da je Casino Avala pokrenuo postupak legalizacije i upise koje je ishodovao, ne predstavljaju novi dokaz, niti dokazuju pravo svojine nad dijelom Hotela. Sud je još dao instrukciju Privrednom sudu Crne Gore, koji je inicijalno ukinuo navedene presude, da mora ponovo odlučiti o zahtjevu Casina Avala za ukidanjem istih, ovog puta zakonito, te da ima u vidu argumente koje je našao Vrhovni sud.
“Mediji su sa velikom pažnjom ranije opširno prenosili kako Beppler&Jacobson Montenegro pokušava već šest godina da izvrši pravnosnažnu presudu kojom je naloženo iseljenje Casinu Avala, međutim prije dešavanja u Katastru o kojima se sada izjasnio i Vrhovni sud, Privredni sud je kontroverznim odlukama odlagao izvršenje iseljenja pozivajući se na ugrožavanje socijalnih prava radnika Casina. Taj scenario koji je viđen još nekoliko puta kada su pokušavana izvršenja presuda protiv firmi za koje se priča da su u dobrim odnosima sa pojedinim sakrivenim strukturama. Da li će se sada postupiti u skladu sa instrukcijama Vrhovnog suda ili će još jednom pravno nesuvisla argumentacija o navodnim „pravima radnika“ biti važnija od pravnosnažne presude, pokazaće dani pred nama. Svakako, bilo bi sjajno kada bi ovakvu „zaštitu“ radnika, pojedini naši sudovi pokazivali i u sporovima u kojima učestvuju ti isti radnici”, zaključeno je u saopštenju.
