Advokati u ponedjeljak odlučuju o pokretanju štrajka
Upravni odbor Advokatske komore zakazao je Skupštinu te asocijacije za ponedjeljak 17. maj, na kojoj treba da se odluče o pokretanju štrajka u slučaju neuspješnih pregovora sa Ministarstvom finansija o izuzimanju advokatske djelatnosti iz fiskalizacije računa koja treba da počne 1. juna.
Kako je navedeno na sajtu Advokatske komore, glasanje će se obavljati elektronskim putem, odnosno slanjem skeniranog i pečatiranog glasačkog listića na mejl komore, glasanjem na nekom od punktova koji će biti otvoreni u pojedinim akvokatskim kancelarijama u 12 gradova i u samim prostorijama Advokatske komore.
Oni su na sajtu objavili glasački listić na kojem piše “Da li ste saglasni da Upravni odbor Advokatske komore Crne Gore, u slučaju neuspjelih pregovora sa Ministarstvom finansija i socijaInog staranja, u pogledu izuzimanja advokata iz primjene Zakona o fiskalizaciji u prometu proizvoda i usluga, donese odluku o obustavi rada svih advokata u Crnoj Gori?”.
Zatim su ponuđeni odgovori “Za” i “Protiv”, a ispod je prostor za potpis i pečat advokata.
Posljednja runda pregovora advokata i predstavnika Ministarstva finansija i Uprave prihoda održana je prije četiri dana, nakon čega su iz Advokatske komore saopštili da je ostvaren napredak i da će obaveza fiskalizacije biti najvjerovatnije odložena do kraja godine a da će do tada biti postignuto rješenje. Međutim, iz Ministarstva finansija su istog dana odgovorili da o odlaganju fiskalizacije nije postignut bilo kakav dogovor.
Jedino što je dogovoreno je novi sastanak za ponedjeljak, kada je i zakazano glasanje advokata o mogućem štrajku.
Iz Ministarstva su ranije saopštili da je rješenje o fiskalizaciji primjenljivo za advokate i da je nekoliko njih već završilo tu proceduru.
“Što potvrđuje da je navedeno zakonsko rješenje primjenjivo na advokaturu. Zakon o fiskalizaciji u prometu proizvoda i usluga nastavlja da se primjenjuje u skladu sa definisanom zakonskom dinamikom. Ovo Ministarstvo i Uprava prihoda i carina nanovo naglašavaju da će sve svoje kapacitete staviti na raspolaganje advokaturi, u cilju primjene tehnoloških rješenja Zakona”, kazali su iz Ministarstva navodeći da advokati za porez duguju 5,4 miliona eura.
Predsjednik Advokatske komore Zdravko Begović juče je kazao da su spremni na razgovor oko svakog razumnog i primjenjivog načina oporezivanja u pružanju pravne pomoći, što je jedina djelatnost advokata, kao i da im je mišljenje ministra finansija Milojka Spajića neprihvatljivo.
“Nakon što ste poslije razgovara održanih sa predstavnicima Ministarstva finansija i Advokatske komore, kojima nijeste prisustvovali, iznijeli mišljenje o advokaturi kao djelatnosti na koju se mora primijeniti Zakon o fiskalizaciji, uslijedila je snažna reakcija advokata ka organima Advokatske komore i jasan zahtjev za sazivanje vanredne skupštine i stupanje advokata u potpunu obustavu rada”, naveo je Begović u dopisu Spajiću.
