MUP CG ima dokaz da je Jokić državljanin Srbije, a on da – nije
MUP Crne Gore saopštio je da Vladimir Jokić, predsjednik optštine Kotor, posjeduje državljanstvo Republike Srbije od 2013. godine te je, u skladu sa zakonima Crne Gore, pokrenut postupak da mu se oduzme crnogorsko državljanstvo.
-Aktom Uprave policije- Sektor kriminalističke policije od 05.07.2017. godine obavješteni smo da je lice Vladimir Jokić, rođen 24.01.1988. godine u Kotoru, upisan u evidenciju državljana Republike Srbije za matično područje Novi Beograd, za 2013. godinu, pod rednim brojem 1661, a na osnovu rešenja Ministarstva unutrašnjih poslova R. Srbije Tom prilikom su nam dostavili kopiju uvjerenja za Jokić Vladimira o državljanstvu Republike Srbije, izdato 12.05.2017. godine, nakon čega je ovo Ministarstvo 07.07.2017. godine pokrenulo postupak, po službenoj dužnosti, gubitka crnogorskog državljanstva po sili zakona, shodno članu 24 stav 1 tačka 1 Zakona o crnogorskom državljanstvu (,,Sl. list Crne Gore”, broj 13/08, 40/10, 28/11, 46/11, 20/14 i 54/16), saopšteno je iz Ministarstva unutrašnjih poslova Crne Gore.
Kako se navodi, Ministarstvo je, shodno članu 31 stav 3 Zakona o crnogorskom državljanstvu, uputilo poziv, u cilju daljeg vođenja upravnog postupka, preko Filijale za građanska stanja i lične isprave Kotor, imenovanom da se izjasni o činjenicama i okolnostima iz člana 24 ovog Zakona, odnosno na činjenicu da punoljetni crnogorski državljanin, koji ima i državljanstvo druge države, po sili zakona gubi crnogorsko državljanstvo ako je dobrovoljno stekao državljanstvo druge države, kao i da da izjavu koje državljanstvo želi da zadrži, crnogorsko ili državljanstvo druge države, u konkretnom slučaju Republike Srbije.
Jokić se, kako se dodaje, odazvao na poziv Filijale za građanska stanja i lične isprave Kotor, dana 03.08.2017. godine, i izjavio da nije državljanin Republike Srbije, niti bilo koje države i uz izjavu dostavio kopiju potvrde Ministarstva unutrašnjih poslova Republike Srbije – Direkcija policije, od 04.07.2017. godine, u kojoj se navodi da se ne nalazi u evidenciji državljana Republike Srbije.
U daljem upravnom postupku, Ministarstvo će u skladu sa Zakonom o crnogorskom državljanstvu i Zakonom o upravnom postupku izvršiti provjere autentičnosti prikupljenih dokaza u postupku, kao i druge radnje propisane zakonom, potrebne za donošenje odluke.
-Uvidom u evidencije crnogorskih državljana, ovaj organ je utvrdio da je lice Jokić Vladimir upisan u registar crnogorskih državljana, po porijeklu, za matično područje Kotor, dana 12.02.1988. godine. Ovaj organ je, uvidom u dokaze pribavljene po službenoj dužnosti, utvrdio da je imenovani državljanstvo Republike Srbije stekao 2013. godine.
Crnogorsko državljanstvo po osnovu porijekla imenovani je po sili zakona stekao rođenjem, na osnovu državljanstva roditelja. Članom 24 Zakona o crnogorskom državljanstvu je propisano da punoljetni crnogorski državljanin, koji ima i državljanstvo druge države, po sili zakona gubi crnogorsko državljanstvo ako je dobrovoljno stekao državljanstvo druge države, navodi se u saopštenju.
Zaključuje se da je crnogorsko državljanstvo po osnovu porijekla imenovani po sili zakona stekao rođenjem, na osnovu državljanstva roditelja, što je u skladu sa Zakonom o državljanstvu Socijalističke Republike Crne Gore („Službeni list SRCG“, br. 26/75) koji je bio važeći u trenutku rođenja imenovanog.
