Piperović: Neefikasno i tromo pravosuđe tjera strane investitore
Povodom više procesa koji se odigravaju pred crnogorskim pravosudnim organima, pravni zastupnik kompanije “Beppler&Jacobson Montenegro”, advokat Zoran Piperović ukazuje da ovakvo ponašanje nanosi ogromnu štetu ne samo njegovom klijentu nego prije svega nesagledivu štetu Crnoj Gori.
“ Ovakva situacija je prosto neodrživa u jednoj pravnoj državi. Podriveni su i zakoni i Ustav Crne Gore. Kad se osvrnemo samo na nekoliko procesa i osnovne činjenice koje niko ne osporava vezano za slučajeve kompanije “Beppler&Jacobson Montenegro” a koje vrlo pažljivo prate svi ozbiljniji potencijalni investitori, pitam se kakvu sigurnost oni mogu očekivati pred pravosudnim institucijama ?! Kad neko od njih zna samo na primjer slučaj da na svim instancama donešena pravosnažna presuda prema “Casino Avala” d.o.o. se ne izvršava, kako onda da se usudi da uloži svoj novac u Crnu Goru ili da uopšte posluje u njoj. U ovom procesu “Beppler&Jacobson Montengro” protiv zakupca “Casino Avala” dva puta je sudski izvršitelj krenuo da uradi svoj posao. Umjesto izvršenja “Casino Avala” se posluži jeftinom mahinacijom i kod kotorskog Osnovnog suda podnesu tužbu kojom traže utvrdjivanje prava vlasništva nad kazinom ?! Pa zar bi vlasnik pristao da sa hotelom “Avala” odnosno kompanijom “Beppler&Jacobson Montengro” 5 godina prije toga potpisuje ugovor o zakupu da je zaista bio vlasnik toga. I takva besmislica prolazi i traje godinama kod kotorskog Osnovnog suda koji nema sluha da uvidi ili neće da uvidi takav nonsens.
Šta tek reći za fingiranje “Casino Avala” sa plaćanjem struje i komunalnih troškova, gdje je zamislite ironije , kompanija “Beppler&Jacobson Montengro” morala da plati te troškove u visini od oko 460 hiljada eura jer je ona zakupodavac dok zakupac besramno troši i neće da plati. Divna poruka stranim investitorima”, kaže Piperović.
Piperović ukazuje i na nedavni slučaj sa isplatom plata prvobitnom menadžeru i posebno se osvrće na nedopustivo dug proces u tužbi protiv Elektroprivrede. “Spor je nastao zbog požara od 15. juna 2008. godine koji izbio u magacinima koje je koristila kompanija “Beppler&Jacobson Montenegro” a za koje je vještačenjem i svjedočenjima utvrdjeno da je nastao u jutarnjim časovima krivicom EPCG a ne zbog udara groma desetak sati ranije- kako je pokušala da dokaže tužena strana. Usljed požara na instalacijama zapalila se roba u vrijednosti od oko 978.702 eura i ona se potražuje od EPCG uz zatezne kamate kao i troškove parničnog postupka. Sve je jasno i gotovo ali neobjašnjivo je da su sudovi prihvatali razmatranja besmislenih naknadnih, grubo rečeno ,“odokativnih” vještačenja kad su imali relevantno sa lica mjesta maltene na dogadjaju”, objašnjava Piperović.
Advokat Piperović podsjeća i na odugovlačenje u slučaju zahtjeva povraćaja stvari vrijednosti od više stotna hiljada koje se nalaze kod firme “Caldero Trading Limited”.
“Nešto što se normalno i lagano završava u 4 ročišta traje 4 godine ! Takvo neefikasno i tromo pravosudje tjera strane investitore i nanosi ogromnu štetu strankama u sporovima”, zaključuje advokat Piperović.
