Vlada Crne Gore je odlukom o privremenom finansiranju prekršila Ustav i organski zakon o budžetu i fiskalnoj odgovornosti, istakao je lider PzP-a Nebojša Medojević.
Kako navodi lider PzP-a, ministar Milojko Spajić je, suprotno zakonu, potrošio za prva četiri mjeseca 633 miliona eura, bez kontrole i bez ustavnog i zakonskog osnova.
“U svakoj demokratskoj državi SDT bi već saslušao Spajića i pokrenuo krivični postupak, a premijer bi ga razriješio. U našem slučaju, zbog ovako brutalnog kršenja Ustava i zakona o budžetu i trošenju 633 mil eur, morala je pasti Vlada”, kaže Medojević.
Dodaje da je član 100 tačka šest Ustava je precizan: Vlada predlaže budžet i završni račun. Vlada predlaže, a Skupština usvaja budžet.
“Član 82 tačka pet Ustava: Skupština donosi budžet i završni račun”, navodi Medojević.
Kako kaže, svakome činovniku u Ministarstvu finansija je ovo kristalno jasno
“Saučesnik u ovom kriminalu je i predsjednik Skupštine koji nije upozorio Vladu da je odluka o privremenom finansiranju Vlade neustavna i nezakonita, jer Vlada nema tu nadležnost”, ističe Medojević.
Ustav je, ističe, prirodno, kao i svaki ustav demokratske zemlje, dao nadležnost Skupštini da donosi odluke o trošenju novca građana Crne Gore, ali i da kontroliše kako Vlada troši novac.
“Zato u sistemu javnih finansija imamo i DRI koji treba da kontroliše da li se novac građana troši po zakonu, ali i da li se troši efektivno, tj. namjenski za ono za šta je planirano budžetom.
Čudi me da se Skupština već nije obratila DRI za mišljenje da li su odluke Vlade o zaduženju, promjeni potrošačkih jedinica uredbom i donošenje odluke o privremenom finansiranju zakonite ili ne!”, ističe lider PzP-a.
Vlada je, kaže Medojević, morala da pošalje Predlog Zakona o budžetu do kraja godine.
“Skupština je nakon odbijanja tog predloga zakona, morala sa donese odluku o privremenom finansiranju i odredi rok Vladi. Jednostavno, Skupština je ustavom nadležna za donošenje budžeta, kao i odluke o privremenom finansiranju”, navodi Medojević.
Lider PzP-a tvrdi da je Vlada postupila suprotno od toga i napravila teško krivično djelo.
“Nered u javnim finansijama, nezakonitost, neregularnost, tajnost, netačnost će se popravljati godinama. O riziku od korupcije zbog tajnog, netransparentnog, protivustavnog i nezakonitog finansiranja i činjenice da samo jedan čovjek, bez ikakve kontrole troši 633 miliona eura za četiri mjeseca, ne treba ni pričati”, zaključuje Medojević.
